Privacy Policy
1. General provisions
1.1. This Privacy Policy explains how the Operator collects, processes, stores, uses and protects personal data when you use the following services (together, the Services): - the website unicornsmarketing.com (the Site); - the Telegram bot @SMMSHelper_bot (the Bot); - the mobile application SMMS Helper (the App). 1.2. The operator responsible for personal data processed through the Services (the Operator) is Yaroslav Thorenko, an individual. Contact email: info@unicornsmarketing.com. 1.3. This Policy applies to all users of the Services, wherever they are located. Personal data is processed in accordance with the laws applicable to the Operator and, where applicable, the data protection rights that apply to the user based on their location. 1.4. The Site, the Bot and the App use a single data storage infrastructure, so this Policy applies to personal data processed through any of the Services.
2. What personal data we process
Depending on how you use the Services, we may process: - name, if you provide it; - contact details: telephone number and Telegram or WhatsApp contact details, where provided; - request details: description of your request, the requested service, budget and company name, if provided; - technical and source information: country inferred from your IP address, country associated with your telephone number, source page and UTM parameters; - consent information: the date, time and fact of giving consent, and the version of the document. We do not collect or process through the Services: national identification numbers, passport data, delivery addresses, payment data, precise geolocation, push notification tokens or order data.
3. Why we use personal data
3.1. We use personal data: - to receive and respond to requests and enquiries submitted through the Site or the Bot; - to contact you about our services; - to enter into and perform service agreements; - to maintain and improve the Services and analyse their use; - to comply with applicable legal requirements. 3.2. Where processing requires your consent, we ask for it separately. Where we process your data to respond to your request or to comply with a legal obligation, we may do so on that basis, as permitted by law.
4. Consent
4.1. Where consent is required, it is given voluntarily and must be informed and specific. 4.2. Depending on the Service, consent may be given by: - ticking the relevant checkbox when submitting a form on the Site; - pressing the “I agree / Accept” button in the Bot, or sending the first message; - pressing the “I agree / Accept” button on first launch of the App, where applicable. 4.3. You may withdraw consent at any time by sending a written notice to info@unicornsmarketing.com. After withdrawal the Operator stops processing the data and deletes it within 30 calendar days, unless a longer retention period is required by law. Withdrawal does not affect the lawfulness of processing carried out before it.
5. Storage and international transfers
5.1. Personal data of users whom the Operator identifies as located in the Republic of Kazakhstan (by IP address or telephone number code) is stored on a server physically located in the Republic of Kazakhstan. Personal data of all other users is stored on a server physically located in the European Union (Austria). 5.2. A copy of the personal data of users located in the Republic of Kazakhstan is transferred to the server in the European Union (Austria) to administer requests and operate the Services. 5.3. Because the Services use Telegram and WhatsApp and the administrator accesses the data remotely, processing may also involve cross-border transfer, regardless of the user's country. 5.4. The Operator takes reasonable measures to protect personal data in any such transfer and applies any additional safeguards that applicable law requires. When you send a request form, you tick the box confirming your agreement with this Policy and the Consent to Personal Data Processing; the fact of ticking the box, with the date, time and document version, is recorded.
6. Data security and retention
6.1. The Operator takes reasonable technical and organisational measures to protect personal data against unauthorised access, loss, alteration, disclosure or destruction. 6.2. Personal data is kept only as long as reasonably necessary for the purposes described in this Policy, unless a longer period is required by law. When data is no longer needed, it is deleted.
7. Your rights
7.1. Depending on your location and the applicable law, you may have the right to: - receive information about how your personal data is processed; - access your personal data; - have inaccurate or incomplete data corrected; - have your data deleted or blocked where applicable; - withdraw consent where processing is based on consent; - object to certain types of processing; - request restriction of processing where applicable; - receive a copy of your data in a commonly used electronic format where applicable; - lodge a complaint with the relevant data protection authority. 7.2. To exercise your rights or ask a question about personal data, write to info@unicornsmarketing.com. We may need to verify your identity first. We will respond within 30 calendar days.
8. Changes to this Policy
8.1. This Policy is a public document available through the Services. 8.2. The Operator may update it from time to time; the current version is always published through the Services. Where required by law, users will be informed of material changes.
